Welcome to Psycholux (available at https://psycholux.ai/). These Terms of Service ("Terms") govern your use of the Psycholux service ("Service"), which provides personalized, AI-generated gut-directed audio therapy intended for relaxation and general well-being.
The Service is provided by Psycholux ("we," "us," or "our"), with core operations based in Prague, Czech Republic.
Age Requirement: Due to the sensitive nature of the topics covered, you must be at least 18 years old to use this Service. By accessing or using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.
2. Service Description
Psycholux provides a web-based tool that allows users to submit a description of their personal stressors or symptoms (e.g., stress-related digestive discomfort, general gut health, everyday stress, anxiety, or sleep disturbances). Using artificial intelligence, the Service generates a personalized 8-9 minute audio session (a blend of hypnosis and meditation) designed to support the gut-brain connection and general relaxation. This digital good (MP3 file) is delivered via email.
3. Mandatory Medical Disclaimer (Please Read Carefully)
Psycholux is not a medical provider, and the AI-generated outputs do not constitute medical advice, psychiatric care, or formal therapeutic treatment.
Psycholux is a self-guided audio tool designed for relaxation, education, and nervous system regulation. Psycholux has not been evaluated by the FDA, MHRA, or similar regulatory bodies. Our content, including AI-generated personalized sessions, is for wellness purposes only and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Do not alter any prescribed medications without consulting a medical professional. Always consult a physician for medical advice. Results may vary.

4. User Input Rules & Acceptable Use
When submitting prompts or problem descriptions to generate your audio session, you agree to the following rules:
No Emergencies: You must not submit prompts relating to severe mental health crises, self-harm, suicidal ideation, or life-threatening physical emergencies.
No Illegal Content: You must not submit prompts that are illegal, promote violence, hate speech, or abuse.
No Third-Party PII: You should not submit sensitive personally identifiable information (PII) of third parties. Keep descriptions focused on your own physical sensations and stressors.
Sanctions for Misuse: Psycholux reserves the right to refuse service, cancel orders, block your access, and permanently ban you from the Service without a refund if you submit prompts that violate these rules, applicable laws, or the Acceptable Use Policies of our AI partners (Google Gemini and ElevenLabs).
5. Intellectual Property & Limited License
All generated content, audio files, software, and underlying technology remain the property of Psycholux or its licensors.
Personal Use Only: Upon payment, Psycholux grants you a limited, non-exclusive, non-transferable, revocable license to download and listen to the generated audio files for your personal, non-commercial use only.
No Resale or Distribution: You may not copy, resell, redistribute, broadcast, or use the AI-generated audio for any commercial purpose. This strictly enforces the licensing terms passed down by our AI text and voice generation partners.
6. Payments, Delivery, and Refunds
Payments: All payments are processed securely through our third-party payment processor, Stripe. We do not store your credit card information. Pricing is displayed at checkout.
Delivery: Audio sessions are delivered digitally via email in MP3 format. Delivery times may vary depending on server and AI processing load but are typically completed within minutes.
7-Day Money-Back Guarantee: We offer a 7-day, risk-free guarantee. If you are not satisfied with your audio session, you may request a refund within 7 days of purchase by contacting hello@psycholux.ai. Refunds will be issued to the original payment method.
7. Indemnification (Compensation For Damages)
You agree to indemnify, defend, and hold harmless Psycholux, its owners, affiliates, partners, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms, your misuse of the Service, your violation of any third-party rights (including intellectual property or privacy rights), or any content you submit through our web forms.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
"AS IS" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
No Consequential Damages: Psycholux, its affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or emotional distress, arising out of or related to your use of the Service.
Liability Cap: In no event shall our total aggregate liability to you exceed the total amount you paid to Psycholux for the specific Service giving rise to the claim.
9. Governing Law
These Terms are governed by the laws applicable to the jurisdiction of our core operations (Czech Republic/European Union). However, if you are a resident of the United States (including California) or the United Kingdom, nothing in these Terms shall deprive you of the mandatory consumer protections afforded to you by the laws of your state or country of residence.
